Premier Online Digital Entertainment Corporation (“PODEC”) is a Philippine Amusement and Gaming Corporation (“PAGCOR”)-accredited Gaming System Administrator specializing in online gaming and live casino game offerings.

PODEC is committed to protecting and respecting your personal data privacy. It is at the forefront of not only implementing but also complying with the Data Privacy Act of 2012, its Implementing Rules and Regulations, and the issuances of the National Privacy Commission (“Data Protection Laws”). This Privacy Notice explains how and what type of personal data will be collected, why it is collected, to whom it is shared or disclosed, until when it will be stored, and how it will be disposed.

1.Who is the Personal Information Controller (“PIC”)?

A PIC refers to a natural or juridical person, or any other body who controls the processing of personal data, or instructs another to process personal data on its behalf. Thus, for all your transactions and interactions with us, PODEC is the PIC.

2.What personal data will be collected?

PODEC may collect and process your personal data such as your name, date and place of birth, present and permanent addresses, contact number or information, nationality, proof of identification and identification number, nature of work, name of your employer or nature of self-employment or business, source of funds, picture, selfie or video, and IP address.

3.Why is Personal Data Collected?

PODEC will collect your personal data upon your registration with its gaming platforms and sites.

4.To whom will your personal data be shared or disclosed?

PODEC will process and use your personal data that you provide to it for the following purposes and with your express consent, unless applicable data protection laws and regulations do not require it to obtain your express consent, as shown below:

For these purposes as indicated above, PODEC will process your personal data it has received about you from public databases including, but not limited to, the National Database for Restricted Persons.

For those purposes where PODEC indicated that your express consent is not required, it will process your personal data to comply with its legal obligations. PODEC will need your personal data if you would like to play with its gaming platforms and sites. Otherwise, PODEC will not be able to allow you to play with its platforms and sites that you may be interested in.

5.Is PODEC using cookies on its website and gaming platforms?

Yes, PODEC uses cookies on its website and gaming platforms to enable certain features and functions on its website (e.g., remembering user ID), build up a profile of how you use the website, improve the efficiency of its website, administer services to you and to advertisers, and establish usage statistics.

Most internet browsers provide you the option of turning off the processing of cookies, but this may result in the loss of functionality, restrict your use of the website and/or delay or affect the way in which it operates.

Advertisements on PODEC’s website and gaming platforms may be provided by third-party advertisers and their agencies. These may generate cookies to track how many people have seen a particular advertisement, and to track how many people have seen it more than once. PODEC does not control these third parties and their cookie policies.

PODEC is not responsible for the content or security of any third-party website linked to its website. You must note that in accessing third-party websites, it is advised that you check its applicable privacy policy to know how it handles the information it collects from you.

6.Until when will your personal data be stored?

PODEC ensures that your personal data is processed in a manner that is compatible with the purposes stated above. For that reason, your personal data may be disclosed to the following parties who operate as third-party PICs:

  1. a. Public authorities such as Anti-Money Laundering Council and PAGCOR; and
  2. b. Partner banks.

For the stated purposes, PODEC may also share your personal data with third-party advertisers and their agencies to send you marketing communications, provided that you have expressly consented thereto. You can withdraw your consent anytime. For this purpose, these third-party advertisers and their agencies operate as Personal Information Processors. PODEC does not share your personal data with non-affiliated third parties for their own marketing use without your express consent.

PODEC may also share your personal data in the following events:

  1. a. To meet any legal obligation, including to the relevant government agency if you make a complaint about the product or service it provided to you; and
  2. b. In the event of any contemplated or actual reorganization, sale, joint venture, merger, assignment, transfer or other disposition of all or any portion of its businesses, assets or shares including in any insolvency or similar proceedings.

7. Where will your personal data be processed?

PODEC processes your personal data both inside and outside of the Philippines, subject to contractual restrictions regarding confidentiality, data protection, and security in line with applicable data protection laws and regulations. PODEC will not disclose your personal data to parties who are not authorized to process them. For transparency purposes, your personal data will be stored in a cloud located abroad.

8. What are your rights as Data Subjects?

Where permitted by applicable data protection laws or regulations, you have the right to:

  1. a. Be informed;
  2. b. Object (example, you do not want to receive marketing communications anymore);
  3. c. Access your personal data that PODEC held about you;
  4. d. Rectify or dispute the inaccuracy or error in your personal data and have PODEC correct the same within a reasonable period of time;
  5. e. Erase or delete your personal data from PODEC’s records;
  6. f. Obtain from PODEC a copy of your personal data and have the same transmitted to another PIC in an electronic format; and
  7. g. File a complaint with PODEC and/or the National Privacy Commission.

You may exercise any of these rights by submitting a request through any of the following designated communication channels. The initial request must include, at a minimum, your full name, address, email address and/or mobile number, along with a clear description of the request. Otherwise, request will not be entertained.

9. How long does PODEC retain your personal data?

PODEC shall maintain and safely store for at least five (5) years from the dates of transactions all customer records and transaction documents. It shall keep all records obtained through Customer Due Diligence, account files and business correspondence, and the results of any analysis undertaken, for, at least, 5 years following the closure of account, termination of the business or professional relationship or after the date of the occasional transaction.

If a case has been filed in court involving the customer’s account, or there is a pending investigation involving the customer, PODEC will retain and safely keep the records beyond the five (5)-year period, until it is officially confirmed that the case or investigation has been resolved, decided or terminated with finality.

You are assured that PODEC does not retain your personal data for longer than necessary. When PODEC no longer have a legitimate purpose in retaining your personal data, it will dispose your personal data in a secure manner by physical destruction like shredding or burning, and automated and manual deletion for electronic files, as applicable. It may also anonymize your personal data in which case, it will no longer be identifiable.

10. What risks should you be aware of when sending data over the internet?

While PODEC has implemented organizational, physical, and technical security measures to ensure the protection of your personal data, it is important to note that data transmitted over the internet may still be exposed to certain risks. These risks include, but not limited to, unauthorized access, data breaches, and interception by third parties despite PODEC’s best efforts to maintain a secure environment. You are encouraged to take appropriate precautions, such as using secure passwords and keeping their devices and software up to date, to further reduce the likelihood of unauthorized access to your personal data.

PODEC is not responsible or liable for the security of your personal data while it is being transmitted over the internet to PODEC. To safeguard your privacy, you may opt to use alternative communication methods with PODEC if you feel it is necessary.
